What should I do?

I bought a pram (new)from Ebay, a large Ebay shop, with lots of feedback.
When I got it the catch that keeps it 'locked' when its in use did not work properly and it does not stay locked because of this it also slopes to one side.
I messaged the seller to tell her. She said to use it for a few days and it might work?!
I would not have used it otherwise but she said to, I messaged her when it was out the packet/box but still unused.
It still does not work - a week later- I asked to send it back as it does not seem safe to use.
I looked on the t and c's and it states I must pay the postage to return it. However this will cost me £18.50.
Does everyone think I should ask for the postage costs back too or just pay it myself?
I don't want to be unfair but nearly £20 is a lot to me.
Thank you in advance for any replies!

yes you can ask but you can't enforce the seller to give you back the return postage. Can't you find a cheaper courier - seems quite pricey.

You are entitled to all of original payment back, item and postage price though.

Surely though Fergoose if there is a fault with the item the buyer shouldn't have to pay to return for a replacement?

fergoose · 23/02/2012 08:53

no they shouldn't have to pay to return - but there is no way you can force a seller to give you the extra money on top. A good seller will give it back though.

It was a heavy pram which is why it cost so much to send.
Thank you for your replies.
I will wait to see what happens when she gets it back.

Update (not good)
I had messaged the seller twice to say I was sending it back. I sent it back to the address on Ebay.

I tracked the parcel online to see the shop was closed and then I got automated replies saying she was 'away from the office' I panicked and opened a dispute and then she send me a message saying I could sent it back for a refund.

I replied saying I had sent it back, she replied my saying when I do send it back send it to a different address than the one on Ebay. She knows I have sent it back already!
I am very stressed, I now have no pram for my 1 year old, no money and I am a bit stressed (and pregnant) about how this will end. And I have already wasted approx. £18 on postage to send it back to her.
Could anyone advise me further?

Thank you!

Have you entered the tracking number into the dispute? An attempted delivery is enough to get you a refund apparently. The address you sent it to - was that the address eBay told you to send it to?

Haribos · 27/02/2012 10:47

I put the tracking number in and I sent it to the address Ebay have for her. Thank you - your reply has made me feel better.

I hope it gets sorted soon. Your seller sounds very dodgy indeed.

Haribos · 28/02/2012 10:24

She was! She said I had not told her it was used, which I did. And she was the one who told me it might work better if I used it for a few days.
She said part of it was missing when I returned it, it wasn't.
She then tried to tell me could not refund me unless I cancelled the claim, but when I checked this it seems if you cancel the claim you have no rights and cannot start the claim again.
A nightmare Ebay purchase. I did get my money back in the end but only after I messaged her politely, but firmly explaining that I would take things further if necessary.

Oh that old chestnut, I can't refund you until you close the case. What a crummy seller.

lagoonhaze · 28/02/2012 11:50

Did you get your return postage back? Even if she did i would leave neg feedback warning buyers to make sure they look at policies as she gives incorrect info.

Can you report her to eBay for breaching policies?

Haribos · 28/02/2012 16:30

No I didn't get my postage back. I have never left negative feedback before and I don't want to but I think I might have to. She sells prams and baby stuff so its probably going to be other pregnant people or new mums who don't really need all this drama who would buy from her.

I think I might also report her to Ebay as if I had not checked then I would have cancelled my claim like she told me to and lost the pram and money as well as postage costs.

Do leave her neg. It's the only way she will actually care. Be very concise and calm though. Expect positive feedback from her which contains negative comments- this can be removed though.
