Faulty item after 35 days, no response from seller

I bought a android tablet pc (ie fake ipad) for my iPad loving DS. When I bought it the seller had good enough feedback reviews. It took nearly a month to arrive and had no communication from seller. During this time the sellers feedback plummeted, due to delivery times & poor communications.

Fakey iPad was not even looked at over Christmas and remained in the box until mid January. It's rubbish shite, unresponsive & basically unusable shit!

I have tried to contact seller, no answer to numerous emails and mobile number is dead. I am fecking fuming as £64.99 is basically down the drain. eBay won't open a case as its 35 days after purchase

I know it is sort of my fault for not checking the item sooner but please, please help to me track the seller down and try and get a refund or send him a virtual dose of cuntworms as I'm so cross. The eBay shop to avoid is technocare_uk and I have his name & address should anyone want to pop round and tell him how much Betty loves him!

Any advice before I tell DH & he blows a fuse? Have also posted this for advice on chat as well with a few extra wishes for the seller that may not be acceptable here

hmm the only thing i can think of is contacting trading standards or something? are they an ebay business?

i would also contact ebay and just see what they say

Unfortunately you are out of Ebay's time limit for starting a dispute. However, as this seller is trading as a business you can use your consumer rights to try and get a refund or replacement that way.

An item should be fit for purpose, as described and of satisfactory quality.
It doesn't sound like your was any of these, however the seller may argue that you had time to inspect the goods but didn't do so, and and may therefore offer a repair or exchange rather than a refund.
You will need to write to them (send recorded delivery) and explain the problems with the item, what you expect them to do to resolve it and quote the Sale of Goods Act 1979. Give them a time limit to respond back in writing - 14 days is usual but you could say 7 or 10 if you wanted to.

The ratings and feedback for this seller are truly awful, and you certainly don't appear to be the only buyer who has had problems. Why and how they get away with it is beyond me. They also appear to have added to their listings that they are having "internet problems" and "phone problems" Hmm

If they do not respond to your letter or fail to rectify the situation then you probably will have to take it further via their local Trading Standards Office or take them to the small claims court yourself.
