What it says on the tin really,

She complained and opened an Ebay dispute a few days after it was posted, i said due to the time of year, it should arrive in a few days - No, more complains, ect so i refunded her, no problems with that.

She has sent me a message saying the item has arrived, however she isnt keep on paying for the item, or sending it back.

So.. what do i do? Is it down to her to pay?

I tried opening a paypal dispute, but it wont let me for some reason.

Does anyone have any Idea?

That's cheeky, if she is having the refund then she has to send item back? She can't have the item she hasn't paid for, right?Hmm

Is it an ebay dispute or a paypal one that she has opened?

You may be able to appeal, if they decided in her favour. If you just refunded and it was closed, then I'm not sure what you can do.

Ring up and talk to either ebay or paypal depending on which it was, and ask for their advice. You have proof she's received the item so seller protection ought to apply to you, and you should get the money back from paypal I think - but I've never used that process so I don't know.

Give them a call.

paypal can't take the money from her now unfortunately - but they can ask her to pay again.

How much was the item - you can threaten her with small claims if she doesn't pay again

How can she justify not paying - am astounded!

I can't believe that she's admitted to you that it's arrived and that she's not going to re-pay/send back!

I'm sure a lot of people would have kept quiet - unless of course you sent it Recorded and can check the tracking

I suspect you'll just have to suck it up.
Probably she should post it back at her expense.

Fergoose, I'm not sure how paypal seller protection/ebay seller protection works, but I remember when I rang them the other week regarding chargebacks, they said that if the seller disputed a chargeback and they were covered by seller protection, they'd be able to get the money back from paypal - it wouldnt be affected by the buyer, as in it wouldn't come from the buyer. Paypal would pay it. They could try and reclaim it from the buyer but might not be able to. They said the seller would still be covered.

oh I didn't know that - like a no fault refund but with paypal and not eBay then?

I had a refund once and then weeks later the item turned up and paypal asked me to pay the seller again, which I did. I guess it has changed since then.

Its a hard one, you say learn from your mistakes, but it she really hadn't received it pay-pal would have sent her the money back anyway. I did ask her to wait a week or two but nope, eBay dispute was opened.

I've learnt to post all my items recorded delivery, However it wasn't enough to take her to a small claims court, so too bad!

She said 'i dont want to pay for it, as ive bought another one now' - it was a handbag.

but thanks for the advice, i will give them a ring tomorrow!

I am sorry but she can't just keep it - she should either pay or return it to you.

What is morally the right thing to do is to return it or pay, however PayPal/eBay can do nothing for you it is down to you if it was worth a lot you take court action if peanuts just leave it and put her on your blocked bidders list.

But even if you sent it recorded delivery that wouldn't make a difference, would it? You'd just be out-of-pocket another 70p. Because whether it arrived is not in dispute :(.

If you didn't know she had it then you could in good conscience plan to put in a claim to RM for lost item.

I think I've sold about 300 things over the last 10 years on Ebay, and this Christmas is the first time that I've had such a spate of plonker buyers. Only my 2nd NPB, and another lady bit like OP's buyer, who tried to open a dispute 24 hours after she paid & less than 4 days after auction ended (she gave me good feedback too, in the end Confused). Currently I have a buyer who doesn't understand how to use Paypal or can't seem to receive Paypal invoices. Eeejits.

I suppose it balances out for how understanding buyers were last year when stuff took 3+ weeks to arrive due to all the snow.

If she's genuinely bought another as she thought it hadn't turned up, then of course she won't want to pay for it, BUT she ought to then return it to you (you could offer to cover return postage).

She wouldn't lose out that way.

Was it very delayed in getting to her - had she been waiting ages for it to arrive or did she open a dispute immediately?
