What happens if you open a case against the seller?

I bought an item mid October which never arrived.

There has been poor communication from the seller, in that I think he is stringing me along. He is very polite and genial when he does message me but he is always seeming to ask for more time, for the item to arrive, for him to check with the post office what might have happened with item, to recheck my address with me, etc, etc.

It transpires finally that he might have sent item to wrong address as he had incorrect postcode [not my fault, it is correct on my account].

Finally he agrees a refund. I wait a week, no refund forthcoming. I contact him and he says sorry he has been busy but will look into how to refund [says he has never had to do this before]. Now two more days go by, no communication, no refund.

I myself have looked into how to refund, looks pretty simple to me. I think he is stalling.

I am sick of chasing him. I have four days left to open case with ebay.

Just wondering what will happen if I open case. And is it best to do so with ebay or paypal?

open a case now firstly - you only have 45 days so get it done.

I agree he is stalling, if you open with paypal then you can escalate immediately

Seller gets a black mark against them when you open a case

And make sure you leave feedback

I have seen that I can open a case on ebay but not sure how to do this on paypal...

I will have a look at paypal now.

I think you can only open a case with either ebay or paypal, is that right?

yes you can, but if you do it with eBay you need to wait 10 days to escalate

go to www.paypal.co.uk and log in then at the top dispute a transaction and open a case. Then you can escalate it immediately.

Hi again... sorry to be dense but this is what I don't quite understand...

I have now opened a case with paypal and it seems to be asking me to mediate with the seller... I can escalate to a claim up till 14th Dec.

Do you think I should escalate to a claim immediately?

Sorry, first time I've had to do this!

Yes I would escalate it immediately - I think you have waited long enough.

Well I don't feel particularly good about adversely affecting anyone's ebay rating but I do feel i have been very patient with the seller and have finally run out of patience.

Thanks for all your advice Fergoose. I will now await paypal's verdict!
