not totally happy with an item & sellers terms

just bought something off ebay and tbh i am a bit disappointed.

it was a pair of gloves, by a good name and for children

was described as in excellent condition, but they are a bit dirty and scuffed and they reeked of fabric conditioner (which is a pet hate of mine)

anyway the dirt hasn't come out in the wash ( and the smell is still there)

the seller doesn't usually accept returns but will do so at their discretion. BUT will charge a 20% stock charge, presumably on top of the return postage which i would pay anyway??

Are they allowed to do this? They are a TRS / shop.

it was only £8 so I am not really too upset about loosing the money.

you are entitled to a full refund, but you will have to pay the cost of returning them with a signature

have you emailed them stating you are not happy with them

Thanks fergoose for that information.

I haven't yet emailed them. I am just a bit indecisive about the whole thing.

I've washed them now so I guess that means I've accepted them.

YOu washed them they are not in the condition you received them in the seller does not have to accept any returns.

Sorry next time just open an Item not as described dispute and put in the details, item does not match description item smells.

Sellers can charge restocking fees, that review is incorrect, if you cannot find it yourself I will point out where eBay state a seller can in fact charge a restocking fee providing it is stated on their listing.

My employers charge one, I thought they were wrong, I looked and found out in fact they are not wrong.

When linking to reviews make sure your read up on eBay before taking the word of a nobody over the words of eBays pages.

Look at the terms and conditions, it state restocking fee if applicable.

What might not be the case in point of consumer law does not really apply to eBay as enforcing what should be and what is are two different things.

but if you opened a not as described dispute the seller would not be able to charge a restocking fee would they

they can also not refund original postage either if they say so clearly in their terms, this is more for change mind ie you buy coat in your size but just like the shoes not every size 14 fits perfectly so as it does not fit quite right so you want to return, so long as in their terms clearly they only have to refund price of coat this does not apply if coat was missing button ie not as described
