So unfair!!

I recently sold some toys on ebay, one had been opened and (by me) but never played with - and I described as such. I got a really stroppy email from the buyer saying it was a tatty piece of junk and she wanted to return it. I said no beacuse the postage had already cost me a bit more than I had charged (my fault) and the item was bloody brand new (although I described it as v good condition), big bulky item, would have to collect from PO and I work full time, stated in my listing no returns etc. Anyway, she then sent me a barrage of rude, offensive emails, opened a case and won (even though you can clearly see in my pics the item is brand bloody new, all shiny, perfect box etc). So I now have a negative feedback, no item, the money has been refunded by ebay out of my account - how can this be fair?! They didn't even read the case because the email saying they had opened it and the one with the "decision" were sent literally seconds apart. It's a bloody joke. I am spitting feathers! I have never had a problem before, and I can't quite get my head around it. Surely this just means buyers can do what they like? Make any old false claim safe in the knowledge that as they buyer it's win-win for them?

have eBay actually given the buyer the money back or just frozen it?

Normally they will tell the buyer to return it to you first before giving back the money to the buyer.

Or have they issued the buyer with a no fault refund out of their money?

It looks like they have give the refund out of my account but I've seen no mention of my item being returned, and it wasn't mentioned in the email they sent me - they just said they were making a refund but the money has gone from my account. I am so so angry, especially as it's all automated, I have no recourse, and I'm nearly £50 out of pocket.
The woman was mad, totally mad - some of the things she claimed and said to me were unbelievable, and her feedback is outrageous too. I honeslty can't believe this is how it's happened, that I'm seen as the bad guy. The item was new, and actually better than described. Angry Angry

ok that doesn't sound right, I am sure you should have had the item back first

I think it is worth you contacting paypal or eBay live chat about it

Normally paypal take the money and freeze it, and when the buyer gives proof of delivery or attempted delivery then paypal will refund

Thanks fergoose, I will check, I'm sorry if I wsound ranty, had a really bad day and this kind of sent me over the edge. I might have read it wrong in anger [embarrassed]

no don't be embarrassed - check your paypal and look at the transaction for the item, that may give you come more info.

fergoose is right about the procedure of these cases.
I had a case recently and agreed to refund upon return (had done from the start but the buyer oddly enough still opened a case to request a refund upon return ( ??? )
The money was frozen to start with but then when the buyer had given the tracking number which indicated the item was on its way back to me they issued her with the refund. When I received the item I saw she had sent a different item back (old dirty and damaged) - I appealed the decision within ebay and they found in my favour and refunded my refund.
This is what I suggest you do. Read through it all to see what is happening. If they do actually refund her then appeal. Stay calm within the appeal, stating all the facts and pointing to your photos etc.
