Can anyone please advise.

Seller is claiming it was described accurately, even though the brand name wasn't included in the listing and when the item arrived, it was not very good quality!

Think - seller sells mostly Channel and Armani and then lists a beautiful black dress but no brand name.. bidders bid up to a very high price ( so it wasn't just me who was taken in) but I was unfortunate enough to win this items which when it arrives is Primark's best. What can I do? I am happy to return so the seller can re-sell but I would just like my money back. Is there any hope? (Even paying postage and the re-listing fees for seller I would still get a big chunk of money back)

Is there anything I can do? I don't think the DSR's apply here.

Are you sure it does not say anywhere in the list the brand name, even if it is on the little summary box above the description? I thought that you are not allowed to list any clothes now without including the brand name, it is one of the new requirements, and everytime I have listed women's clothes in the last few weeks there is always a notice about it. If she has put brand "unknown" than you might have a case as obviously there is a label somewhere for you to know it is Primark, but otherwise I can not see that the seller has done anything wrong. You assumed it was something that it was not because of her other listings, unfortunately it was an expensive mistake.
I hope you do not follow Fergoose's advise, which I found really devious and was really disappointed with.
And for anybody surprised that Primark can reach high prices on ebay it is not unheard off, for some reason some items are seen as key pieces to have in the fashion worldHmm. I do not shop in Primark because their quality & sizing is really bad but I have sold a couple of dresses given to my daughter and they went for silly money even though it said Primark on the title and description. So there is no accounting for taste!

You need to look very closely at the description of the item by the seller. If the description indicates that this was a high quality, high worth item & it comes from a store noted for its cheap & cheerful products then I think that you can dispute the description. Have a look at the photos too & see if there are any labels showing. It is definitely worth raising it with Ebay - at this stage you've got nothing to lose.

It all depends if there was anything at all in the listing indicating where it was from or implying that it was a designer item. If you were convinced this was a quality item purely because of the price, because other people had bid so much, there's really nothing you can do. Buyer beware and all that.

I sold some Primark pj's for £18 and a cardi for £35, (properly listed) I was astonished, was only expecting a few quid.

Op, I would love a link to the listing, if it isn't incorrectly listed you really don't have a leg to stand on.

I sold a few Primark dresses a couple of years ago and got more than twice what they were sold for. I will admit I bought them specifically to sell on, but purposefully didn't put a 'buy it now' as I wanted them to find their own level, which they did. baabi is right, some people will pay a lot for 'sold out' items from Primark, particularly items that are copies of catwalk stuff.

Anything is only worth what someone's prepared to pay for it.

In that first sentence, I did of course mean what they were originally sold for in Primark. Sorry if it was a bit misleading.

I'd just like to add something if I may.
The op hasn't actually said what the item was which makes it quite hard to give accurate advice on this. However if it was an item of clothing then there is nothing to prevent the op opening a SNAD case.
There is scope within Ebay resolution centre for cases to be opened and items returned under the basis that "The item was accurately described but does not meet the buyer's expectations".
I think that particular clause would apply in this case, the op can open a case with a clear conscience, return the item and receive a refund.
The return postage may not be refunded but the vast majority of the original payment would be returned.

I am a business seller on Ebay and I have had returns under this for a whole host of reasons including "the colour wasn't what I thought"; "It doesn't match the handbag / shoes like I thought"; "I don't like the feel of the material" the list is endless.
Personally it doesn't bother me as I'd rather my customers were 100% happy and I'd prefer to have an item back, refund and relist to sell to someone who will be happy. There is no point at all in having an unhappy customer who leaves a neg.
I recently refunded on an item which was clearly stated as "one supplied per purchase" but the buyer had mistakenly thought she'd receive one in each colour. There were 25 colours listed so for £4.85 that was a huge assumption but I took the return and refunded no issue.

I know exactly what fergoose was saying and she was not implying that the op should cause a problem but simply that SNAD is effectively a catch all reason to return and you can find a reason any reason it doesn't matter. She is a brilliant "spot on" advisor on this board and anyone who spends time here knows that so please stop flaming her for trying to help.

Ebay has put in place a system where the buyer is king so please op open a return request, send the item back tracked, get your refund and then if you wish to leave a positive saying the item wasn't as thought but you are happy with the refund you can do so with a clear conscience.
