Item not as described? WWYD?

I'm relatively new to ebay so wondering what is reasonable in this situation... Advice from seasoned ebayers needed!

I bought a top which was described as brand new without tags. In the photo it showed a packet of buttons attached to the label. The top has quite distinctive buttons around the neckline as a feature. I assumed that the top would come with the attached packet of spare buttons as per photo... However it didn't.
I emailed the seller who said as they had advertised the top as being without tags they did not include the buttons Confused
Is this reasonable? Or should the seller send the item as depicted in their advertising photograph with all relevant attachments including spare buttons?

WWYD? I am now wondering what feedback to leave and want to be fair and reasonable. I am happy with the top and it does look brand new. However I am a little irritated that the spare buttons were not included!

The seller is being a bit silly. Why put the spare buttons in the photo if they aren't included?! Did they mention the spare buttons in the actual description? Either way, I don't think you are being unreasonable in expecting them to be included. Given you're happy with the top (and sound like you don't want a refund), with regard to the feedback you could:
i) not leave any
ii) leave positive but mark description star ratings down + make a comment with regard to missing spares
iii) leave neutral + make a comment with regard to missing spares

I wouldn't leave a negative - that would be way too harsh!

Hope that helps Smile

I'd just email her again and ask if you could have the buttons, offering the postage.

It does make me wonder if the photo is a current one of this actual top.....

... or whether she took the photo from somewhere else.

I think that if the buttons were in the picture then you are reasonable to expect them.

What do you want to do? Would you want to return the top for a refund?

Thanks again to everyone for advice.

I emailed seller again and they said they would send spare buttons the next morning... however they never arrived...

Emailed seller again to ask if buttons were sent, seller never replied to my message.

I am happy with top and have decided to keep it. However I am taking Givemestrength's advice and am going to give neutral feedback with comment about missing spare buttons.

I think if the seller's photograph of "brand new" top specifically showed packet of spare buttons attached to label it should include these!

I think legally the photographs constitute part of the sales description and a seller has to tell you if anything isn't included ie without tags does not translate as without spare buttons in my book if clearly shown then should be included.

I have had goods that were damaged that was almost hidden in photos but not mentioned in description and the seller has told me the photos (however indistinct) form part of his description so it works both ways.

For future ref you can also ask sellers for a partial refund as a compromise I have done this on a couple of occasions and then given positive feedback as we came to a mutual agreement over the amount of refund. It makes sense if the seller agrees especially if they have been a bit 'free' with either the description or photos.

Thanks Adalle. I will keep the partial refund in mind for future reference.

I did think this seller not including the buttons was a bit cheeky. The photo was one taken of the top on the floor, so not a picture from a catalogue IYSWIM. I could understand if it was a stock photo, ie that showed buttons as standard for item bought direct from store [but then seller should have explained in advert that buttons were not included]. But for the seller to show packet of buttons attached in his advert and then to remove them prior to sending item is a bit off IMO.
