do i have to accept returns??

i sold some jeans, clearly described the waist and leg measurements but the buyer says they are too big and wants to return

i'm trying to clear stuff out and really don't want the hassle of having to resell.

i'm always buying things i don't like when they arrive but don't expect to be able to return if they don't fit properly

i told buyer the jeans were described accurately so i didn't want to accept returns and got a narky reply about their 7 day protection.

do i have to accept return??

Also, the distance selling regulation applies to all items purchased from a "business seller" at a distance. This in the uk is 7 days after receipt of item.

Are you trading on ebay under a business name?

I do not think you have to take the return but im not 100% sure. You will probably get awful feedback though.

the buyer could open a sig not as described case against you.
Ebay's view on this is as follows

Examples of situations where items are NOT considered significantly not as described:

*

  The defect in the item was correctly described.
*

  The item was properly described, but the buyer didn't want it after they received it.
*

  The item was properly described, but did not meet buyers' expectations.

If you feel you fit into the above then you could take a chance on the case.

tbh it is usually easier to simply tell them to return them for a refund and then relist them. Saves the hassle of a dispute, having a mark against your seller status and risking a neg feedback.

writing sold as is, or I do not accept returns etc etc is pointless as this will be over-ridden by ebay should the buyer open a dispute. The only time ebay will find in a seller's favour and not issue a refund is the 3 points up there ^. even then, it's not a definite.

Only business sellers have to accept returns, however a good seller would accept them and refund only the item cost.

Advise your buyer that you are a private seller and do not have to offer a returns policy on items that do not fit, however in this instance you will accept the return providing they pay return postage trackable and accept back the item cost only.
