Item not as described - no contact from seller, when to open dispute?

I won an item at the beginning of last week, it arrived a few days later but was not as described - was a different brand (maternity clothing). I wouldn't have bid as high (if at all) for the brand I received - I specifically wanted the brand I bid for as I know it would fit perfectly, which this one doesn't really.

I contacted the seller immediately and she has agreed that it was her error, and offered to refund the item if I send it back.

I replied saying I didn't think it was fair that I should lose out twice on postage because of her error, and I would accept either a partial refund of the item or a full refund including both postage costs.

I have since not had any contact from the seller.

Seller seems to be fairly new to eBay but has 100% feedback, but one of the "feedback's" implies she's done this before as it says "item not as described but seller refunded item".

Would you open a dispute about this, or is there a more suitable way to go? And how long would you leave it before taking it further?

to get a refund you would need to return it by trackable post. You will receive a refund for the full amount you paid ie cost +p&P. A good seller would refund your return postage but they are not obliged to.
I would opena dispute now, but be aware that you will need to return it in order to receive a refund

I had a similar problem last year,but the seller refused all contact.I opened a dispute and ebay refunded and told me not to return the goods,as the postage was more than they were worth.

If you open a dispute you do not get return postage back, only what you initially paid, however I would open a dispute if the item is of no use to you.

If you open a dispute then you can also put that you will accept a partial refund and keep the item.

If the seller responds then you will have to send it back by trackable post which you will have to pay but you will get the cost plus the postage original paid back.

If they don't respond to the dispute then you get to keep the item and get all your money back. This has happened to me twice but I threw the clothes away as they were so bad!

I would do it as soon as possible.
