Won an item - buyer says they've already sold it!!

I bid on the item in question, then received a message saying:

Sorry mate, not available any more. Had it on Gumtree too and someone bought it earlier.

I initially replied saying they should take it off, but they said:

Tried but can't. LOL.

I have now won the item. What do I do now and how do I complain? I think this is really poor show!!

Did they say they were advertising it locally?

They will probably ask you to cancel the transaction so that they can recoup their seller fees.

Nothing you need to do. You could leave negative feedback. Can't remember if you can cancel an auction in the last 12 hours.

They can take it off eBay listing if it is no longer available. I have, when I burnt a skirt ironing it.

V poor practice to have it advertised elsewhere if also on eBAy imo.

Not sure how you complain though.

they can cancel their listing..as long as it's not 24 hrs or less to go, i think.
i've withdrawn my listings a few times due to mistakes.
I would leave a neg just for the fact that they've been so unprofessional to list it on two different sites. I wouldn't if they'd made a mistake or the item got broken, though.

Listing has now ended and my bid supposedly won, so they can't remove it now. I've left negative feedback but will try to cancel transaction, too.

You pay for it, let them refund you, then you leave a neg.

Then report as a non performing seller. If you don't pay for it you can't leave a neg and they can file a no paying bidder dispute.

They can cancel if there are no bids up till the end of the auction, or if there are bids if there are more than 12 hours to go.

I had exactly the same happen to me, I contacted eBay and they told me not to pay and if the seller tried opening a non payment dispute then I should let them know and they would sort it out, they also said I could leave whatever feedback I wanted and it wouldn't be removed.

I went through the 'contact us' tab at the top left of any ebay page.

update to my last message..have just purchased 3 identical items on buy it now..and the seller says they only have 1 left!!! The listing said 5 left.
It is so annoying eh!!

really? I quite often have stuff on ebay and on ohter places, tend not to be sales, but maybe offering them on MN, or books on a swap site I use. Never realised it was frowned on - in my defence I want rid of these things, and if I just list them on ebay most of them don't sell - I aim to maximise my chances of getting rid of them rather than necessarily selling them

Yes they should have removed the listing but they did contact you straight away and let you know so why are you wanting to neg them?
People advertise on ebay to sell things, it is quite normal to advertise in many places. It is good practice to mention it on the listing or course.

At the end of the day what exactly have you lost? You placed a bid and the buyer said "sorry no longer available" why on earth didn't you just go nd find another one?

they can cancel if there are no bids, which is what they should have done

or if there WERE bids then they should not have sold it elsewhere

it serves them right to get negative feedback and not have their fees refunded

I am aware it is an auction site. My point is that she was told before the end of the auction that it was not available. She knew before the price was set that there was no item so why not just move on at that stage and find another item to bid on/buy private.

It is a bit pointless bleating as there is no item for them to provide you no matter how much you stamp and the fact is that they let you know asap so you didn't actually lose anything!

Possibly but then I would expect him to wait until after the end of the auction to contact bidders as so much of the action happens then IYSWIM?
