Items lost in post - who is responsible- buyer or seller?

My DH bought something from Ebay and it looks like it has probably gone walkabout in the postal system.

The seller in question is a business seller.He has stipulated in his description that he accepts no responsibility for items that go missing in the post and that he he always obtains proof of postage receipts which he will forward onto the buyer to make a claim from the PO.

Now I always thought that missing items are the seller's responsibility even if it was the PO's fault for losing it.

What would you do if you were us? If we contact the seller asking for our money back, is he entitled to fob us off by offering to send us the receipt. What would happen if we open a PP dispute - will they take his side as he has in effect made a disclaimer in his listing?

God, am fed up with ebay at the moment...

You are correct it is the sellers responsibility.

Open a paypal dispute, the fact he put a disclaimer means nothing.

Thanks. I am surprised ebay allows business sellers to write this sort of thing in their descriptions.

Seller's responsibility. If it was a high-value item he (the seller) should have insisted on recorded delivery.

It makes me cross when I see statements like that. You bought an item, you didn't receive it, his problem.

i had this with an item not so long ago.If the seller didnt send recorded or signed for they dont have a leg to stand on as a proof of postage receipt means nothing.
There is no way of matching one of those receipts up to the item as it could be for anything.There is nothing on it to say an item was being sent to you.
File a dispute with ebay and you will more than likely get your money back as they will contact the seller who will need to prove they sent the item (which cannot be done with a standard receipt)

I think he has to open the lost parcel claim anyway, I don't think you can do it.

Paypal will give you a refund if you open a dispute, because he did not use a trackable service when he sent the parcel. Proof of posting is not enough, as I found to my cost when I sold a Playstation.
Email through Ebay him asking for a full refund, and tell him that you do not want the proof of postage because any claim made is his responsibility not yours. If he does anything but refund, open an Paypal dispute immediately.
