sold item on ebay buyer saying it's not as described -please help

Hi please - brief details are:-

sold item on ebay and stated on advert that 'everything work fine when last tried'.

Item was sold in good faith. We assumed it worked fine but it was not tested.

We did'nt say on the advert that it was guaranteed to work. Its a collectorss item and really only something that would be bought by an enhusiast due to age of it. eg 20 years old.

Buyer took item home and tried it. and has contacted us and said:-

It does not work as per your advert.
This leaves me with 2 options.
I can bring back item and get a full refund plus costs or i can get it sorted out via a help site and you pay for the repairs.
I will want a reply within 24 hours so as to know my next course of action.

How do we stand in this situation. We are not a business it was a private sale. thanks.

hmmmmmm. why didn't you test it? when was the last time you tried it?

Hi,

It's a bit complicated.

It's a Sinclair C5. so it can be peddled around or can run on a battery.

We didn't have a battery for it. It was stored in the garage for the last 12 years, and never really looked at.

When it was bought it did run on a battery.

So we just prosumed it would probably run ok when connected to a battery again.

So thats why we stated everything worked fine when last tried.

I think you should have checked it..if you don't want to refund you should probably speak to a lawyer to find out where you stand.

i would take it back, it was 12 years ago that it worked??? Shock

the buyer should have asked you when it was that it last worked, but the advert made it sound recent.

not worth the hassle, take it back and refund.

take it back, pay costs of return, refund cost of item, relist as project rather than working item. It annoying when things get returned but this is what you should do I think.
