Moving eggs from Spain to the UK

Hi, I wonder if anyone experienced the same issue or can share some information.

I have my frozen eggs stored in IVI Valencia clinic. For personal reasons I would like to move them to the UK and have my treatment with Kings Fertility Clinic. I officially initiated the transfer in August 2022 and IVI was very fishy about the whole process. They told me upfront that it will take some months to transfer because they need authorisation for transfer to the UK from the Ministry of Health in Spain. Apparently this is due to the UK no longer being in the EU. I spoke to my transfer courier and they reassured me that typically the whole process takes about 2 months. I didn't have much choice anyway so went with it. 2 months later I checked with IVI about the progress and they told me that they only sent the request to the Ministry of Health mid September and in October received the request for more information, which they provided. I was asked to wait a little longer. So I did, for another 2 months. After hearing nothing form IVI I chased them again and they told me that the Ministry refused the transfer and I have to do the treatment in their clinic. I am completely shocked, in disbelief and frankly disguised. THis is MY eggs and I have a right to have a treatment in my home country. I was not given any reasons for refusal. Kings Fertility is a very reputable clinic with long standing history. SO my question is, what do I do now? How do I get my eggs from Spain? Did anyone here experienced the same issues? I am desperate because I have very limited time left to get pregnant. This situation is a nightmare. I could not find any information about the need to get permission for transfer, or any conditions on why the transfer from Spain is not permitted. I have a slight suspicion that the clinic deliberately screwed up the application, or simply lying to me about the whole "authorisation" thing, so they can keep me as a paying customer.

Well my frozen eggs thawed and fertilised well, they just didn't make it to day 5 so think it's more to do with the drug protocol perhaps and egg quality, the one thing I would say is if you can freeze embryos instead of eggs it will improve your chances. 37 is still really young so maybe one final round before the surrogate route? Its so hard to know what to do, this is my 7th round and genuinely, every cycle is totally different so I've given up trying to understand why things happen!!!

@NinoT86 Georgia is looking to ban surrogacy for non residents.

The government in Georgia cited a number of safety concerns for both surrogate mothers and children and human trafficking risks.

The U.K. only allows for 'altruistic' surrogacy only and importing non identifiable donor gametes and embryos is not permitted.

Hi ladies,

I am beyond happy to have found this page, similar situation to you -
I live in Zurich, had my oocytes frozen in Barcelona (Dexeus clinic), and now plan to do IVF in London (Avenues clinic). I have been chasing the Barcelona clinic since Nov 2023 and they sent the documents to the Spanish health ministry mid Feb 2024.

My situation: I am collecting new oocytes in March (in two weeks) and was hoping to use the frozen and fresh batch together for IVF to have higher chance/number of embryos for success.

My problem: the spanish clinic emailed me that it might take 4-5 months to get the approval from the ministry, is there anyway for me to speed up the process? Is there an email you can send me, or phone number, or even your lawyer info? I don't mind paying extra for someone in Spain to sort this out, if this could be an option.

Very frustrating how much we are not in control of our own body/health.

Hello, i'm in the same situation. I need to ship my frozen eggs from IVI Madrid to a clinic in the UK and IVI already said it will take 6 months if not more. I hate them and suspect they're gonna do the same than what they've done to you. Have you found a resolution in the end ? Thanks

Hi dear,
I’m so sorry you’re going through this. It took me a full year - I started the process in October 2023 and finally got my oocytes in London in October 2024.
I worked with this group of lawyers (email below) - let them know Ella recommended them. I also spoke with a UK newspaper that reached out to the Ministry of Health for comments. We filed for a court date, and that’s when I finally received the notification allowing my oocytes to be moved.
For context, I’m not a Spanish citizen or resident.

They needed a reason to approve the transfer and it seems "I want to" is not a good enough reason?! They were asking for a medical reason and even though my IVF clinic in London send the request that I am going through their services was not enough reason.

Note that the oocytes freezing is usually 30-40% of the total cost of IVF - they don't want to release our own oocytes because of money.

I ended up taking them to court -

Thank you so much. Did you take to court the clinic or the ministry? Would you mind sharing the details of your lawyer? I may have to do this as well I'm afraid as IVI Madrid does not even answer to my messages. I have a small child so I can't go to spain for weeks , also I don't trust IVI anymore and want nothing to do with them.Thank you so much for sharing, I hope your situation is better now.

No, I didn’t take it to court as didn’t need to. The clinic sorted out quite efficiently in my case. So it was just me communicating with the clinic, didn’t involve a lawyer.
Sorry to hear your case isn’t going smoothly. maybe try calling to them and locate the right contact.

I actually moved my oocytes from IVI Valencia to London like 2 years ago. It took some time but less than 6 months for sure. But you never know, as getting the approval from the Ministry takes time but I was not in a hurry and should say that the admin staff at clinic did their best so I was satisfied with the response rate.
You can just keep checking the steps and the respective timeline with your contact to make sure it

I am not European (Canadian) so not sure if being European helps here or not.

Here is my lawyer info, it took me one year and getting the ministry to court to move the oocytes to london. One year to the month (Oct to Oct)
