Financial Disclosure

Currently going through divorce (I originally posted on her over a year ago. Husband left after 17 years together, 2 children, got with colleague days later blah blah).

Anyways, long story short, we planned to go through financial mediation. I had my 1:1 session, all fine. He had his. Got an email shortly after to say mediation wouldn’t work for us. Ex the. Text me to tell me he was worried that a full Fiona vial disclosure would cause me to rant and add to his ‘anxiety’.

So, the next step was solicitors. I found one almost immediately and she got to work. She emailed him and gave him 14 days to reply. He didn’t. He has now been given another 7 days just to knowledge the email and agree to gather all the necessary financial documents (bank/pension statements, p60 etc).

What id really like to know is:

-What happens if he still doesn’t reply after 21 days?

-If he does share his financial documents, as I will also have to do, do we get to see each others? Is

i would appreciate any advice.

He will be made to disclose his finances.
He will have to share his financial documents but its also important to think about what you know about his finances as he may try to hide accounts/pensions etc. You do get to see each other's which your solicitors can then query if needed.
He can't get out of this but ultimately he can make it tricky by delaying.

In 21 days nothing will happen, other than a Reminder email or letter ( costing you money )

ultimately he can be compelled to disclose via the courts but you can spend tens of thousands of £ and years to get there

do you have a general view of what there is? Ie house/pension/savings etc. is there complex matters ( businesses/foreign assets etc(?
are there any mitigating factors to warrant a deviation from 50:50

A solicitors letter is just a letter from someone. I could get a solicitor to write to you and say that you had 21 days to send me the deeds of your house. You would quite rightly rip it up. The only body that can force anybody to do anything is the court. Have you any idea why he thought a full financial disclosure might make you rant? Is he just being a dick it might there be more or less than you are expecting. As mentioned above, don’t forget to take into account the cost of a combative divorce. Well worth it if there is plenty of money to split, but not if there isn’t.
