Hoping someone can shed some light on this.
The CMS have completed an annual review, and reduced ExH salary to an incorrect figure. They have taken a figure from the last tax return (April 2024) not his current PAYE salary. They did this originally a year ago when the case was logged. On a phone call, they checked HMRC/PAYE records and adjusted his income to his (then) current PAYE salary.
The last tax return salary is significantly lower than his current salary, due to a change in circs. Income increased significantly in August 2024 (hence the adjustment in Nov 2024).
They have now done an automated annual review, and reverted the salary to the (lower) April 2024 amount. This is despite the case having operated for 12 months on a correct salary.
They are now saying they cannot adjust the salary to the current live one - despite having done this over the phone in November 2024.
What process should they follow? Every time I call I am given a different response, and half their staff don't seem to understand their own process so I am obviously going to need to drive this.
I am a bit rusty on tax return timings, but I'm assuming that if they insist on tax returns, that'll be an April 2025 return date, to be submitted in Jan 2026 latest? How long would that take to filter from HMRC to CMS?
For the year to April 2025, he would have needed to do a tax return for reasons of self employment. From April 2025 onwards he may possibly need to do one for non-employment reasons.
Any pointers or advice so I can hopefully steer CMS. The monthly drop in CMS if they insist on the April 2024 salary is not insignificant and I need this sorted asap.
