Hi all, we are at the stage of sorting the financial split so we can apply for the final bit. we agree on the terms (very simple as we earn the same, have similar pensions, no savings etc) do we need to complete form e or is there a simpler form? googling brings up different answers and form e scares me as so much information is needed. Thank you

If you've agreed then you just need to fill in a d81 and a draft consent order

See thats what i was hoping to hear! Some googling says that, others say a form e is always required to ensure fairness

and can this all be done by us or does solicitor need to do the draft consent order?

No just d81. We did pay for the consent order to be done against my better judgment but was too complicated to diy. The solicitor just asked for our pension information because that’s all we were splitting at that point, everything else was done. The final paperwork just stated 55/45 split and the exact pension percentage he was transferring to me, very simple though they charge a lot for the legalise document!

Cheaper was an online divorce paperwork company that would have saved £300 but was much more hassle

D81 form - you do need to pay a solicitor to write the consent form but if you are amicable you could get away with just one of you having one (like I did) and then split the cost afterwards

Thank you, this is very helpful

Its so difficult to navigate even with all the information out there! Luckily we both agree and all is amicable otherwise can see how it can get very stressful!

My exH and I were the same 10 years ago but still used a solicitor and split the costs. Yes we could have done it ourselves but the first financial order was thrown out as I wasn't making a claim on his pension. he wasn't making a claim on mine and once we had explained it was all OK but I was glad we had spent the £1500 on a solicitor to write everything up into legal speak.
