Hello
Sorry for contacting you when i don't have children, but I am asking on behalf of a friend who does.
She and her partner have 3 children, all under teenage years. They were due to get married in a couple of weeks, but she has just found out he is having an affair, so the wedding is off.
Two of her children have not been well (hospital not well) so this is the last thing she needed.
I know where I think she stands morally, but I would like to know where she stands legally. The house is completely in his name, but she pays her share of the bills. Can he turf her and their 3 kids out and effectively turn their lives on their heads, or does he have a legal obligation to give them some sort of stability. I really want to help her and would be grateful for some advice.

He has a duty towards the children if they are his. Which i think they are due to your op.

she doesn’t have a claim on his assets. She may be able to get some rights to remain in the house using sch 1 of childrens act but this will likely be costly. and if successful she would be awarded any £ just the right to live there for a given time.
