Pension split?

Pls someone help sense check this for me?

Married for 22 years, lived together and pooled money for 25 years total, 4 children together.

Both partners worked full time until birth of first child with similar incomes (B earned slightly more)

B worked very part time until last child went to school (approx 14 years), then went full time again. A worked full time throughout.

Partner A has a pension pot of 538k
Partner B has a pension pot of 100k

Is a 65/35 of the total (638k) split in partner A’s favour fair?

It all depends on what other martial assets there are and how they are to be split, the principle of 50/50 would apply overall.

Marital not martial...

Nothing else to be split. House is already sold and equity divided 50/50, same with savings. Kids move 50/50 between each parent

The starting point is 50/50 in all assets. If the house is already shared 50/50 the pension pots should be shared 50/50 too. Sometimes there is an increase in equity to offset pensions which is why the settlement should never be done piecemeal.

It’s probably not likely to be deemed fair. Are both parties the same age and are both earning similar now ?

What are their salaries now? Has person B caught up with A after having taken a career break? Have you seen a family lawyer? Where will the children live?
A family lawyer will take into account the fact that if person B is still earning less than A due having shouldered the family responsibilities, B has less ability to build up a pension pot of their own, so they might suggest sharing unequally in favour of B.
