Pay Out from Work and Divorce

I’m separating from my husband and due to move into my own place soon. I work for a large company and I (along with others that I work for) are in line for two financial settlements. One is related to equal pay and the other is related to a pay discrepancy. It’s difficult to say how much I could end up with but it might be £10,000 approx or less. Will my ex claim half if we are not divorced yet? I’m on a low wage and he’s on 4 times more than I am. Thanks.

Yes unfortunately, he told me him and his mother were talking about the pay outs - it’s been in the news.

You're getting this money because courts have ruled that's what is fair, and you're concerned that another court might say it's fair that you share it?

Anyway the answer is going to be, it depends on lots and lots of other factors, including children, housing, other savings, age, needs, etc.. But, in principle, this settlement is likely to be added to your savings and hence be part of what is shared. Because, in part, it is money you should have been earning for the last few years. However, the same goes for any savings or assets or pensions of your higher-earning ex, that they may be shared with you.

It should be included in the pot for division along with anything rise. Whether it’s enough to impact splits is unknown to anyone here

Well yes it will go in the pot with everything else. It doesn’t sound like either of you have started divorce proceedings yet though. When are you expecting the money?

When I divorced I had just been made redundant and I had a lot more than your amount. I can’t say I kept it as such as there was equity from the house sale and savings and pensions etc and ex and I got a proportion of it all (I got a lot more as I had the children full-time.)

You will only know when you do the financials as part of the divorce so get a solicitor to give you advice.
