Financial Court - keeping the children’s home

My ex husband and I separated 2.5 years ago. When he found out 6 months ago that I’d been dating someone of 8 weeks he became aggressive, threatening and controlling.
we attempted mediation but he didn’t engage. He stopped paying for the joint mortgage.
After two failed financial disclosures and £15k in legal fees, he’s now taking me to court.

He wants me to sell the children’s home- mainly out of spite because I’m seeing someone. He had two affairs and left me for one of them, but can’t handle me being with anyone or his children around anyone.
He moved in with his girlfriend last July, but is now claiming to just be a lodger and is needing the children’s home to be sold so that he can buy a place. he’s been with her for 2.5 years now.

The mortgage is currently jointly owned and I’m having to pay for it on my own. I got a second job so that I could. I offered to pay him some money to give him a deposit on a property, but he refused.

I can afford the mortgage on my own.

In his financial disclosure today, it’s packed with so many lies. He has a history of mental health.

I’m desperate to keep the children’s family home so that they have some stability. They’ve been dragged into this all at age 5 and 7.

I’d love to hear other experiences of financial
court and how the system goes.

Can you afford to release any equity he’s due, buy him out and then take on the mortgage and bills ? If so, you’d be most likely be allowed to keep it. Him not paying the mortgage doesn’t diminish his share.

if not, you may be forced to sell but there’s not enough information here for anyone to try to make an informed view
