Maiden name on mortgage

Morticia27 · 08/03/2025 17:47

Divorce is finally completed and exH is remortgaging to pay settlement, however the mortgage has my maiden name on ( it was taken out before we married and I just forgot to update with married name).
I have birth certificate ( maiden name) and marriage certificate to show the change, will this be sufficient or do I need to do anything else.
Ex is suggesting it won’t be straightforward,

I can't see why this could possibly be an issue. If he's buying you out I presume you're coming off the existing mortgage? I don't believe you need proof of ID for that.

I can’t see the lender having any problem with it. Your maiden name is still your name, using a married name is more of a courtesy than a legal requirement.

Yes, buying me out, and me coming off existing mortgage.
I didn’t think it would be an issue, but just want things to be concluded as soon ( and smoothly) as possible !

The bank have a know your client obligation under anti-money laundering obligations so should have all your accounts linked, so your marraige cert and any regular ID (if you decided ro get ID under your married name) would be fine. But you are not borrowing your contract is ending.

He is getting a new loan for which you dont need to provide any documents as you are not a party to that borrowing.

He is using the new loan to pay off 100% of the old loan so the source of the funds is trackable under his loan application.
