Income disparity, assets split and spousal maintenance

Hi all,

Me and my husband has decided to divorce after nearly 18 years of marriage. We have 2 kids still in school. I have given up my full time job and currently do part time work 12 hours a week to be the main carer of the children. My husband is on 6 figures salary and this is 10x the amount I earn.

I need advice on how assets should be split and how this will affect my spousal support if i am entitled to any and how long due to the income disparity.

My husband has proposed transferring the house to me as his pensions should covers it should we split 50/50. And the rest of the cash and investment. I am getting 60%. The children will continue living with me in our marital home. He will pay child maintenance and spousal support that will cover expenses but not the mortgage. He said he will pay for the mortgage for the next two of years until the kids are at secondary school but he wants this amount back when I sell the house to downsize. He also said he will only be expected to pay spousal support for next 2 years as i am expected to retrain and get a full time job as well as looking after the children 90% of the time.

I been told i should get a larger split of the asset as I need to house the children. My husband disagrees and said if I get larger asset he doesn’t pay spousal support or he pays less.

I am going to seek legal advice but before I go to my appointment, I want get a sense of whether this is fair and what will the court outcome might be if it does go to court.

Yes, you need to see a solicitor asap. Spousal maintenance is rare these days and usually short-term if awarded.

You’ll generally be expected to work FT if your DC are over 8, and up your hours in any case.

You can also check if you’re entitled to any UC and help with childcare etc.

In terms of split of assets, you may be awarded more but you’ll need good legal advice.
