I am going through a messy divorce after a long marriage. 2 kids.
My ex is claiming he's is not working or working less as sole trader. He has well established business. He is also claiming ill health depression ect.
We live in Housing association property. The tenency is in his sole name. He is not been in the property for a year now through court orders. He does not want to give up his life time tenency. ( we have lived in it together since he obtained the tenency)
This is why he is claiming he is earning alot less, more than half than he was before the divorce started. Because he wants to pretend his earning capacity is very low due to ill helath. He wants us to move out so he can have his tenency back. This is why he is saying he is working less and in ill health. He also says he is homeless. When actually he earns enough money to rent or get a mortgage. He is living with his parents not homeless. He has alot savings.
My question is. If I got PI to follow him and prove he is working, not depressed and living with his parents would this stand up in court and could I use it. I have a solicitor. Thanks

Why is the tenancy in his sole name
who lived there first - if it was him, how did he become eligible for a family sized home as a single man ?

will he be allowed/entitled to live there on his own if it is bigger than his legal needs ?

He pretend to be a alcoholic to obtain it. I was 6 months pregnant with his child when he got the property. be promised to put me on tenancy but never did.
It's a two bedroom. one child sees him rally one won't see him. so no he does not need a 3 bed house

Have you informed the housing officer that

  1. you are married
  2. have his children
  3. He is not been in the property for a year now through court orders.

Yes I have. I can get a transfer of tenancy. We are applying for that. As he is trying to pretend his situation is suddenly so bad, that's what worries me. It's not true he is working g and earns alot of money

it will be down to the court to decide who gets the tenancy. This is why he is making up all these lies in hope they will let him keep it
