XH running up debts/financial consent order.

Hi all,

Looking for some advice. Divorced
XH 2 years ago and stupidly have been putting off the financial consent order due to the stress and thousands I spent sorting out the child arrangements (he used to ignore my solicitors letters which soon racked up the bill). I’m hoping to get a financial consent order with a clean break. We have no joint assets and I don’t want anything off him. I mainly want the clean break order to stop him having access to any future inheritances.

He’s on a high salary while I’m on UC ( young dc but currently looking for work). I have about 6k in savings which has been declared to UC. I have scrimped and saved since separation, had to sell my car. Meanwhile he’s been going on around 5 holidays abroad each year and buys fancy clothes. He asked to borrow money last year (I declined) and it turns out he has maxed out credit cards since separating.

Going to ring the solicitors tomorrow but wondering if I would be liable for these debts he’s incurred post separation or have to give him a portion of my 6k savings to cover them? It seems so unfair if so as he is on a higher salary and has flounced his money away. He also once declared how he has thousands in cash in his home country but obviously there is no proof of this.

Any advice greatly appreciated!

I’m sorry you’re going through this. I’m not sure if it helps but it’s just come to light my ex has run up a lot of debt since we split, we are now at the financial stage and he’s said that the debt is his and he is responsible for it, as I have with my own (despite most of it being marital) and he’s been ordered to disclose his finances everywhere (although predictably hasn’t). I think if you have concerns about income being concealed then you can instruct a forensic accountant but as part of the mediation process/financial order you will both have to disclose and provide evidence of your assets, income, debts etc which you can then look through and ask questions on. Everything will be much clearer once you get to the point of mediation/Form E and you’ll be able to act on what you can see (and perhaps not see) on paper x

Any debt my husband had in his name was his responsibility in my divorce - even where it was a credit card in my name but I could prove it was used to pay for something for him (I had to take one out to pay off another of his old credit card debts)

As long as you have evidence of when you separated you should be ok

Thank you both and apologies on my late response! That’s good to hear that the debts will be his responsibility.
Just rang up the solicitors and received an estimate of £1600 for drafting/submitting the consent order. I feel so bitter the amount this divorce has cost me while he hasn’t paid a penny 😣Can’t wait for it to be over!!
