Bit of advice needed regarding No fault divorce

Hi all, worrying myself silly over DS possible divorce, has any one got any advice ref going through Gov.UK to initiate it? No property, no children involved. Both in their late 50’s. Reasonably amicable ( at the minute) Any advice most appreciated. Thank you.

I filed for divorce on the government website last feb and paid just under £600 and it was so easy to do but we had no joint assets or anything like that so it was pretty straightforward and I got email reminders every time I had to proceed to the next step and by September we were divorced

Thank you for reply IhopeIthinkIknow charge seems pretty much like it is now, but I’m confused about something called a Financial Order, is that something you pay extra, I feel it could be. There are no savings between them, but they have had financial difficulties in the past. My DS is very guarded about what he tells me. DIL has a very well paid job, where as DS not so.

There are two aspects

the legal dissolution of the marriage

the severance of financial ties- financial order /consent order. Until you have this in place even though you’re divorced you are still financially linked and either party can still ( years later) make a claim on the other. You should always get this in place ( in my view) before the divorce is final.

Definitely get the financial.order alongside the divorce. Otherwise you're tied assets wise

Definitely get the financial order. It essentially says that whatever the split of assets at time of divorce is it, and neither party can have any further claim on the other. Bizarrely, without it, if your DS won the lottery two years after divorce, his ex could try to claim for a share of it.

I used a solicitor, it was about £1500, but i could have done it myself - i was charged several hundred pounds just for the solicitor to send me and ex Form E, retype it and get us to check it. And take 2 months over it.

If you have Form E done ready for the conditional order date, you can submit it and apply for the final order.

I did the online divorce bit myself, that was super straightforward.

The financial element of the divorce can be dealt with in two ways:-

  1. If you both agree you can apply for a consent order which needs to be drawn up by a solicitor and is sent to the Court with a document which states all the assets and debts of both parties for the Court to see that the agreement is fair to both parties.
  2. If you are not able to agree, you make an application to the Court and have a number of hearings, often parties agree before the final hearing. Both parties have to disclose all assets and debts. The is the most expensive and time consuming option

Cherrytree12345 I think he is going to go through Gov.UK, I assume all will be covered. There is no joint property (council house) children grown up. Hoping it will be smooth going forward. No one else involved. He had simply had enough of being badly treated over time. Financially and emotionally abused. Thanks for your input. Appreciate it.
