So my STBXH and I are at the stage of completing the D81 ready for the consent order to be confirmed by the court.
I was reading through and there's a box that mentions state benefit.
About 3 months ago I applied and I am in receipt of a small amount of universal credit. He is unaware of this and I would prefer to keep it this way but on reading the form I think I need to declare it. Has anyone any experience of this form who could advise?
I will speak to my solicitor but I won't be able to do this for a few days.

Yes you need to declare it - the form is to demonstrate the before and after divorce financial position of both parties - benefits are an income like any other.

Why don’t you want this money declared?

for the judge to ensure it’s a fair settlement it important they know you need to claim UC

I'm divorcing a difficult man and I hadn't told him I was claiming it and was hoping to keep it that way but looks like I need to tell him. Just not looking forward to all the shouting that's going to come with telling him.

If there is going to be shouting at you for claiming UC id record it and report, it’s not acceptable

I think part of the process of divorce is detaching from the person you are divorcing .

It doesn't matter what they think and you don't have to listen to them shouting

I would place the phone down on the side and not listen, yes he got angry about the fact that I didn't listen to him ranting (not shouting) but what could he do/ he couldn't force me to listen. He probably wasn't sure whether I was listening or not - but I wasn't as it was vile. I returned to the phone 30 minutes later and he had gone

The D81 is quite confusing. We had a separation agreement that was signed and enacted in March, including transfer of equity/buying me out of the family home and splitting savings, and me buying a new home. (Would’ve lost out on purchase if we waited for court to sign off consent order)
We only filled the D81 in in about September to get our agreement sort of rubber stamped.

so we didn’t use our September position as the “after” we all agreed it made more sense for the “before” to be just before the separation agreement and the “after” to be just after it, when the transfer had taken place.

Hope that makes sense! I know he’s done well though work since we enacted our financial separation agreement, and I’ve had some money from my parents but we didn’t include that stuff that had happened since.

I didn't want to declare my UC either, same reason, v tricksy exh.
I think it was just entered under state benefits.
As it turns out this isn't what he's chosen to be an arsehole about

Well I've put it on we filled In the form today and I took pictures so we could both send to our solicitors and so far he doesn't seem to have noticed so now I'm waiting to see if he does or not.
