House not selling

Hello,

Not sure where I stand but my divorce has been going on for over 3 years now and got ridiculously expensive, with no fair split in the end as I couldn't go to court (other issues in my life). The house is up for the minimum amount I could accept (I'm only getting a 50% share on the sale of the house, that's it).

I'm still living in the house but 3 bedrooms are stood empty the majority of the time. I have paid for all bills and house maintenance since we split. House is mortgage free.

I really want to move out and get something smaller. The financial order has been in place for ages now so am I able to put an offer on something else? I feel like my life is on hold, still. If the family home was empty and chain free it might help shift it. It is priced below the average asking price around here.

I am no longer being represented by a solicitor. I just can't afford it anymore. I'm paying back a lot on credit cards (solicitor fees over the last 3 years). So. I had no choice but to end their services (not that they had done much for me).

Can I move out? If the financial order is in place then they couldn't touch any new property? Divorce not finalised.

I'm worried his solicitor will push me to reduce the asking price which means I will end up with even less - and can't afford to lose that as house prices are a lot more these days.

Sounds very stressful. What sort of feedback have you had on the house and what offers? Chain free is a bonus but price is more important to most buyers.
Prices are dropping and yours will ring alarm bells if it’s been on for ages. You need to look at what’s selling and not what the neighbours are asking for other unsold properties.
Can you do the maths on a scenario where you move out and carry on paying c tax and some bills on the house for 6 months while a sale goes through? If that would cost you £15k for rent and bills what effect would reducing your house by that much have?

There is a reason it’s not selling - you need to speak to your estate agent ( and others) and find out why / then resolve it ( through price correction if necessary)

house prices on average nationally ( and I realise huge variations) are not dropping and actually seeing modest increases although the market in terms of volumes are down

if this is mortgage free will you really be much better off moving out?

could you short term rent out a room ?

if you have a signed and sealed consent order then any new house you purchase will be outside of that and not touchable. You’ll still have to maintain upkeep in your current home them to ensure things like - heating us out on to stop issues with pipes as we go into colder times, and to prevent damp etc. garden maintenance. Council tax ? Can you get exemption?

you’d also need to understand if capital gains tax - I dont know on this as there are specific rules on divorce etc - but you should ensure you find out before purchasing another property

It's already on for a good £40k less than neighbouring houses have recently sold for. It probably needs a lock of paint here and there but I can sort that.

If it is reduced then I may as well see about buying him out but I don't really need a 4 bedroomed house now and it will reduce my disposable income too much if I go down that route. But, on the other hand, if the price is reduced any more then I'll need to borrow more and again reduce disposable income to a seriously low level. It's really difficult!

Only has two viewing so far. One had lived in Australia (where his garage was bigger than my house!) so his feedback was 'too small' - it's an above averages sized British 4 bed!

Someone else didn't leave any feedback.

With the winter coming on, it makes sense to stay here and keep the place warm etc.
