Ex husband refusing to move out of sold FMH

My very very difficult ex husband is refusing to move out of our jointly owned home which is now sold stc. Exchanged contracts last week with buyer as mortgage has expired and bank want their money back. Apparently he can stop completion by not moving out. Does anyone know how to get the family court to refer up to high court bailiffs? Apparently I will be in breach of contract too 😢

Can you get in there while he's out and change the locks? Yes you'll both be in breach of contract if he doesn't move out . Why is he doing this?

I have order for him to give vacant possession in accordance with contract of sale. He is obsessed with FMH and tried to buy me out for a pittance but then didn’t even apply to take me off the mortgage. Really stressed and sad at same time

In my divorce the judge threatened to take over the sale of my ex didn't cooperate, what's the wording of your order? You might need to apply for some sort of emergency court session and claim for costs?

I don't know the details of this but if you have a court order that he has to vacate once sale is complete, I'd be talking to your solicitor about whether you should be calling the police/going back to court etc. There wouldn't be much point in the order if its not enforceable?

Also, just to add - what a cock. Did you post at the time with his ridiculous offers etc? If so, I think i remember and congratulations for sticking with it!

I think I need to get the matter transferred to High Court for fast bailiffs. Just don’t know how to do it and so worried about what the buyer can claim off me when he can’t get into his house …..

Surely either your conveyancing solicitor OR the solicitor who helped you at the time of the court order can advise?

Thanks, yes they could but after £50k in legal costs trying to do most of this myself at the moment.
