Divorce before reaching financial agreement?

Blondie1806 · 13/09/2024 12:47

I'm about to apply for the Final Order, husband has already done this. We haven't reached any financial agreements yet, shall I hold off and sort our finances first? does being divorced effect the split of assets/pensions etc ?
Thanks for any info.

Do not apply for the final order before the finances are sorted under any circumstances.

JKM66 · 15/09/2024 22:21

Do not do it. Wait for Finances to be sorted. It doesn't take long to receive the Final order.

May I ask why you need to wait for the finances to be sorted?

Because once you're divorced it's over. I couldn't put my house on the market as if it sold before the financial order was done the solicitor wouldn't know how much to give each of us.

The financial split is the main part of the divorce.

You can make arrangements for the house to be sold and the proceeds held in a sort of escrow account, with a third party solicitor, until you've reached a decision on the split. Granted neither of you can move onto purchase a new place so only really works if you're also willing to go into rental properties.

Which would be a no for most people.

Because all the matrimonial assets are not matrimonial anymore after divorce. It just complicates matters.
