Will I lose rights if I move out and the house in solely in his name?

As the title says really. Living together but separated - planning to move out but will my right change to the equity in the house if I’m not on the deeds and it’s in his name?

I don’t think you have any rights! Do you have any documents showing you contributed to the mortgage? DS had been married and wasn’t on the house deeds. She had no rights to it when he died - it went into the estate.

Sorry to drip feed. He started the mortgage in March this year from his personal account not the joint account. I work full time and pay into everything

But there is equity tied up in it due to it being a right to buy and ten years rental contributions by us both - one year only me

The starting point for a divorce would be 50% of all assets. You can register home rights so that you are notified of any changes to the property deeds and your interest/claim but moving out would not effect your claim on the property as you are married.

So it was only bought in March and almost straight away you are divorcing. Doesn’t he have to pay back most of the discount if he chooses to sell within a certain period? I think you need specialist legal advice given the house was purchased with a discount that it sounds only he was entitled to - presumably it was his property or he inherited the rental.

You need to speak to a solicitor.

but broadly, as it is the home you both live in, it is considered the matrimonial home. Regardless of who owns it
