Mobility Car after Divorce

I’m currently in the process of making a plan to separate from my husband. We have a disabled child and recently were granted a mobility car for him. I don’t drive so my husband drives it.

Just wondering what would happen after separation/divorce? I wouldn’t want to force my husband to give up the car, however, our child will realistically spend the majority of time with me as I’m his carer and my husband works full time. I believe that requesting that he gives up the car will cause a significant amount of animosity.

When my husband is in work I rely on paying for taxis to transport my son to various activities as we live rurally.

Is it possible that my husband could keep the car to help with our son but pay me an amount as I would lose out on his DLA Mobility payments?

Has anyone been in a similar situation?

No the car is for the disabled person so he can't use it if it's not benefiting the child.

The mobility car is for the benefit of the disabled person. This might include trips to a pharmacy to pick up their medicine but not a parent going to work.

But you might be better just getting the mobility allowance if you don't drive - which can be used for Taxis etc.

The car is your son's, it is for his direct benefit and while a parent can use the car for work/shopping etc I can't see Motability agreeing to what you propose.

This comes up soooooo many times on the various motability forums I’m in and this is correct. So many people do not understand this.

OP hasn't stated if she drives or not, but seems like it's their only car and DH uses it for work too.

Maybe ask questions before making assumptions

The OP confirms that she doesn’t drive. Which is why she uses taxis when her husband is at work.

I think if you have your child most of the time he needs to give it up so you can have the money back for transport you may need.

The car can be used for a parent to go to work but the car has to available for the disabled child to use when needed. If you are having to get taxis because your husband has taken the car to work then it is possibly breaching the motability rules.
as you are the main carer and are separating from your husband it makes the most sense for the mobility car to be returned so you have the money to use for taxis. Or you could learn to drive.
or your husband could agree to request flexible working so he is available with the car whenever the child needs transporting to somewhere.
but he can’t make the car unavailable for the child at times when the child needs the use of if.
