Help with house sale after divorce

BricksandMortar2 · 27/08/2024 13:51

I’m hoping for some help. My husband and I divorced 6 months ago. I am living in the family home with my 14 year old son with permission of the court. The house is sold, as we agreed, and my husband has enlisted a conveyancy solicitor to deal with the sale. The court ruled that we divide the property 50/50.
I have had no communication from the solicitor at all, the survey is done and all communication has been through the estate agents. I wrote to the solicitor stating I owned 50% of the house (although I am not in the deeds) they have not replied to me. I am told the sale is nearing the end but I have not given my bank details or anything, the last message asked me when I am intending to move out. I’m unsure what to do next. Any advice please?

Do you have a copy of the court order stating 50/50?

BricksandMortar2 · 27/08/2024 20:47

Yes I emailed a copy of the court order to my ex’s solicitor and have had no reply.

Do you have your own solicitor? What have they advised?

You can do something with labd reg that you are notified if the property is being sold, sorry I can quite remember the details.

Are you on the mortgage? Have you contacted the estate agents, sorry loads of questions.

Paper trail email to both estate agent and solicitors asking them to confirm the amount they are paying and when. State you need a minimum of two weeks notice to organise movers etc - but surely you have packed and have a place to go to - moving takes time?

The buyer had originally told me when she visited that the sale would be expected to go through in November. I am temporarily moving in with my parents, however I do need notice.

@Allnewtometoo my solicitor has emailed the conveyancy solicitor but has also had no reply. I am being sidelined. There is no mortgage

Have you put a restriction on the title. You need to urgently if not.

BricksandMortar2 · 28/08/2024 15:45

@feelsbadouthere How do I go about that? Should I ask my solicitor?

At first I thought you had no solicitor & was worried for you. Your ex-husbsnds solicitor wont deal with you direct, so glad to see you do have a solicitor.

Your solicitor needs to communicate with his solicitor. I'm sure they are not ignoring your solicitor & if you dont think the new owner wants to move in until November you still have loads of time.

Do you at least know the price your house has sold for ?

BricksandMortar2 · 28/08/2024 16:57

@Biggaybear the court order stated one should represent us both for the house sale, but I will ask the estate agent if I need to enlist a conveyancy solicitor as well. My previous solicitor dealt with the divorce and will not handle the house sale although he kindly emailed on my behalf to ex’s solicitor

Your divorce solicitor should have put a notice with a the land registery so sale cannot go through without your interest being sorted.
The conveyancing solicitor (I gather your ex has sole conduct of sale?) needs a copy of the court financial consent order to be able to act on it and distribute proceeds accordingly.
If you are concerned that this consent order (which should also say details of when you must vacate) is not being complied with, you should seek advice from your divorce solicitor.

BricksandMortar2 · 29/08/2024 08:16

@Scareystress thank you I will ask the divorce solicitor about the land registry

@Scareystress my divorce solicitor did not put a restriction on the title. Can I do so myself? I no longer have a solicitor as my legal aid was stopped once the divorce was final. Does anyone know the best way to file this notice with the land registry I had a look at the form but I’m not sure how to complete it
