Financial Consent Order Timings

Does anyone have any idea about timings for the FCO going through the court? My STBXH's solicitor submitted the documents on 31.8.24 and I'm literally checking the HMCT portal every 5 minutes to see if anything has been done (I don't trust his solicitor to let me know in a timely manner). The conditional order was dealt with by Birmingham courts so I'm assuming this will go to the same court? Anyone had theirs back within the quoted three weeks? I'm desperate to move into a new place but need the cash from the divorce to get myself sorted!

The timings vary but it's likely to be in the region of 3-4 weeks.

It doesn't go back to the court that dealt with the divorce necessarily, it'll just get allocated through the online portal.

If you got a notice that the application was submitted then that means they've included your details as the 'Respondent other party' and so you should get an e-mail telling you when a decision has been made.

So you can rest assured there's no need to check all the time.

Update: financial consent order took 12days for a judge to look at it but on the downside - he rejected it as its very unfairly in my STBXH favour. We are now waiting on a court date!

So it is roughly 85/15 in his favour! He gives me a cash amount, we dont go for either pension or future inheritance and he gets the house (which I have already left). He purchased the house from the sale of his flat in London which he bought before I met him. So in his (and his solicitors) eyes, I shouldnt get a penny! I also have about £18k of debt in an IVA and my pension is worth nothing. His is a final salary pension which is currently worth hundreds of thousands. I guess the judge has looked at all this and thought its not fair at all so let's bring them both in! I agreed to the low amount as I just wanted it all done and finalised. Now we just have to wait on a court date which could take weeks and weeks.

That’s good to know. Can I ask more about your situation- do you have children and how long were you married for?

Married 8 years when we split and no kids thankfully!
