Hi.I have now got a court date to go to court to hopefully finally agree a financial settlement.Beforehand I have to get in touch with a mortgage broker to see what mortgage capacity I can get and send examples of property's I could afford.I also have to do this for my STBEX and what they could afford and send examples of properties.STBEX will have to do so for me also.we share one child who's under 18,my STBEX has an adult child who is nearly 21 living with them, adult child works, drives, doesn't need dependant care but STBEX states they do 🙄 my solicitor states as that child is adult age and also not my child I'm not responsible for housing them so if I was to not include them in property search would that be alright?has anyone been in a similar position please. Thanks

Neither of you are responsible for housing the 21 year old unless they have a disability that means they need adult supervision - which would be quite a high threshold as many disabled people can live independently with adaptations etc. So you just look at 2 bed properties for both of you. Your ex would need to evidence the 21 year olds needs eg did they have extra support at school or go to a special school, do they receive social care or disability benefits, do they require constant supervision / have a diagnosis etc. there would be independent evidence needed.

No the 21 yrs old is not taken itno account . This is a financial case between you and him. I argued that my daughter 23 will be homeless and is loosing the chance of inheriting the house as it is a HA secured tenancy. The judge said by law we don't consider adult children.
