Informal child arrangement and travel

Hello everyone

I and ex partner has an informal child arrangement that states the children lives with me , the mother. Can I take them abroad for up to 28 days since the arrangement says I am the resident parent? Thank you

Not unless it is a court order OR your ex gives you written permission. Will he do so?

If you have an official 'lives with' order.. Costs just over £200 to get one... Get one then he has no ridiculous way to lord over you.

I applied since March 2023 for court but have just been only give a date for court for July 2024. However I travelled in Febuary 2024 with the informal arrangement and he reported me for child abduction. I was arrested by police and told them I did not abduct and police are still investigating

@Abby1988 What was the schedule for ex to see his child? Did he miss time whilst you were away? Did you notify him of travel and dates to return? Did you offer time to make up missed visits?

Now you have returned has the usual schedule resumed and have you now said you will consult him on all future extended travel?

Residence does not mean you have unilateral vote as your ex has PR so has equal say in parenting. A judge will take a dim view of a parent who acts unilaterally. It would be up to CPS to decide if they prosecute and they will have the details. How you acted and subsequent behaviour is likely to influence their judgement. Essential were you acting reasonably and acknowledging his PR.

schedule is for 2 days a month, child returned back and he saw the child. I inform him I will travel at some point but I didn’t tell him when I took off due to fighting. he was aware I will travel at some point. I never deny him of his contact time, in fact he doesn’t want to pick child and I force him.
