Hi there, wonder if anyone can help. As I understand there are two types of divorce you can do in Scotland, a simple one online, and an ordinary one if you have kids. The one with kids is presumably more complicated because of care etc.

If I have all that already sorted in a separation agreement and finances also complete, can I apply for a simplified divorce?

sorry to reignite an old thread but interested to know the outcome of this? I have my Minute of Agreement and on the cusp of completing the transfer of title etc with regards to house buyout. Wondering what happens next…….how long will it take to get the actual divorce from here? And how much more will it costs now that the hard bit (re MoA and finances etc) are sorted….….

Yes you can as far as I know because I intend to go down this route when my separation agreement is imminently complete

My wife's solicitor asked her if she wanted them to do the divorce as she will only get the pension share once divorced and quoted 500 all in. However if you look at the Scottish courts website you can see the form and it is easy to fill in, I can't remember the cost but it's about 160 or something, plus there could be additional costs if you get a notary or maybe if you need the divorce served, but it looks straight forward on my initial reading. I think it also takes between 8 to 12 weeks depending how busy the courts are

Agree as long as custody and finances are all sorted in a signed legally submitted minute of agreement then the straightforward one should be all that is needed. Of course, your solicitor may just want to get money out of you, so may tell you that is not the case.
