Pension sharing order

Long story short. Divorcing after a long emotional abusive marriage. He is angry, bitter, petty and vicious as how dear I divorce him and wants him out of the house. We split up 5 yrs ago but still live in the same house which has become extremely difficult.
Along with loads of made up stories he has asked the court for pension sharing order. Both pensions' annual statements indicate similar benefits. His NHS 2 yrs old statement shows £8,650, mine TPS April 2024 shows £10,150. I have applied for the CEV in December still waiting. The solicitors submitted form p last week.
My question to people that have had the experience with pension sharing is - would the CEV be much different? If it differs by not a huge amount (which it doesn't seem so), would the judge still grant him the order. My anxiety comes from the fact that he will retire in July this year and the judge might favour him.

Thank you in advance for your time and advice.

Your ex is very petty! The pensions are so tiny and so similar. Unless your ages are wildly different the judge is going to let you each keep your pension. TP charge a fortune to even action the order. And to work out what share you should each get, you’d have to pay an actuary a lot as well.

That seems like a VERY small pension to retire on…! The difference is hardly worth squabbling about… judging by the hourly rate of lawyers these days.

How is he funding his retirement? He must have another pension or assets…

Mumof3confused Thank you . Petty? Evil and horrible. This is just to drag the process as long as possible as he is refusing to leave the house and enjoys making our lives hell everyday. He knows the pensions are not much difference but what gets me is the judge that ordered to apply for the CEV when it is very clear from the annual statements that they are not much different. In a way allowing this and the abuse to continue for longe than it should.
Our age difference is 9 yrs.
Would you know how much in average TPS charges? I don’t this it will come to it buy it might help to have that info.
The judge advised the solicitors to use Galbraith-Tables instead of an expert report as she could see that there is not much to go around.

I am so furious as it can be seen clearly that he is an abuser who has options but is doing this just to be in control.

Ohyeahwaitaminute thank you for your time. He has the state pension, NHS pension and a small pension in our country. The ouse here is a secured tenancy for a HA in both names. We have a 2 bed flat in our country in both names which i have offered to him in exchange for signing his tenancy in England over to me. He refused despite planing to live in our country after retirement anyway. So he would have technically 3 pensions and a free home to live on. He will be way better of than me but this is not the point he knows that is wha will happen at the end but wants to make it as painful as possible. Ville. To think that i looked after this man for more that 38 yrs like a baby, you would think that i earned some respect.
I am nearly over the above feeling as there si no point. I am trying to look forward as much as possible. My daughter and i spent the time dreaming how we are going to strip everything of the house when he leave and how we are going to redesign it. 😀

Thank again even typing this helps.
