Consent order sealing wait time

nyorksdad · 15/03/2024 11:00

Hi

Just wondering if anyone has any up to date experiences on the wait time for a judge to seal the consent order.

This has been such a painful, drawn out experience with my ex delaying, stalling and obstructing at every possible step that I am desperate to click that final order button that is ready and waiting for me!

Many thanks

Mark

The consent order is the financial agreement (that’s what this thread is about - the sealing of the finances) and the conditional order is what you are waiting on. There’s some threads on here re the waiting time of the conditional order.

Jonathan70 · 29/03/2024 10:11

You have to wait for 6 weeks after it has been pronounced not from when you applied. Look at the other threads - you might have to ring the divorce office and see what they say. On the bright side, they said that consent orders re the finances were taking 8 weeks minimum and, as you can see on this thread, they are generally coming back in 4.

UmberSnake · 29/03/2024 12:04

@Tony1989 i think you have applied for the conditional order. I applied for mine on 3 October 2023 and they said there was an 8 week wait. In fact I heard after 2 weeks and the conditional order pronounced on 23 October. It’s then the 6 weeks and 1 day from this date when you can apply for the final order (as long as there is no financial consent order recommended to be approved too before applying for the final order).

Thank you both for you quick reply. Apologies for Hijacking your thread when it's the Conditional order I'm waiting on not a consent order. There is not much up to date information i.e 2024 comments about wait times for Conditional Orders. So hopefully it won't be too long. I'm very hopeful it will be granted in the next 4 weeks

Rang to see where this was up to today (been 3 weeks)

Took an hour to get through to be told it's nowhere near the top of the pile and I'm looking at 10 weeks.. so fed up now

Hi mate,

Strangely I applied on the 27th March. Had response today and will be pronounced in court on the 24th April

nyorksdad · 09/04/2024 11:46

Thanks - that's a conditional order though not a consent order sealing which this is

My solicitor told me that I was looking at months (she referred to an example of one she’d submitted three months previously which hasn’t been returned although this was part of a court hearing). I called the divorce line who said they were taking 8 weeks minimum.
It came through within a month. A few others on this thread had similar advice but ended up with a much shorter timeframe, even with questions. You could get it through much faster? Good luck!

nyorksdad · 09/04/2024 12:50

Thanks Jonathan, I'm hoping for that.

I have a weekend away with my partner at the end of the month.. I booked that ages ago thinking this would all be long done and behind us so it's a race against time now!

@nyorksdad to be honest for consent orders think it’s just a standard response they give everyone, likewise for the conditional order, as I was told 8 weeks when I phoned about that, then heard 2 days later. My consent order took 25 days in total. Don’t be disheartened, I’m sure it will come through sooner.

nyorksdad · 09/04/2024 14:16

Thank you :) Just needed a lift I think and some positivity!

I agree with @UmberSnake - there’s every chance that it’ll be through sooner rather than later. If our timings of 24 and 25 days are any more accurate than the advice given on the phone line, you could be done and dusted within the week, final order soon after - and will be celebrating on your weekend away! My final order came through within a few hours of pressing go, despite being a Friday evening ( although if yours is a joint application, your ex may delay it - although they can only delay it by two weeks, so you really are on the home straight!)
Let us know when you hear the news!

nyorksdad · 09/04/2024 16:02

Thankfully not a joint application or she would undoubtably drag it out for several more weeks! Will keep you updated thanks

That’s good then, you’re almost there!

halfmyface · 12/04/2024 10:41

Eurgh, I posted on 17th March hoping I'd be submitting my consent order that week but still not done as his solicitors transposed some figures so its been back and forth fixing that. Actually started the divorce application in June and was so excited it'd be 26 weeks + 1 day, gonna be twice that I reckon.

UmberSnake · 12/04/2024 19:39

@halfmyface you have my sympathy, I was naive in thinking mine would be fast until my ex started deliberately delaying things as a form of control. I noticed on the D81 there were simple errors where figures were transposed by his solicitor which meant it had to go back like yours . Hang in there and you’ll soon be free

nyorksdad · 15/04/2024 14:31

Hi all - just to let you know I got my consent order back last Thursday afternoon all sealed - so it took about about 3.5 weeks, a lot better than I was told!

Clicked that button and I'm all done! :)

Hope everyone else gets theirs soon!

Thanks so much to everyone who helped and reassured me!

halfmyface · 16/04/2024 22:49

@nyorksdad woo hoo! enjoy your celebrating!

beachguy · 22/04/2024 10:29

Applied for conditional order on 27 March, heard back today, court day 8th May. Can apply for final order after 20th June.

HLS22 · 26/07/2024 09:44

Does anyone have any experience of the below?
My solicitor drafted the consent order and D81. I have completed the financial statement form. Is there any difference is speed of me posting all of the documents against the solicitor sending them? I assume they may have an online portal they access? I just want to avoid more solicitor fees if I can.

Papill19 · 29/01/2025 09:59

Hi,

I know it's been a while since you posted this - but did you send yours by post in the end? Currently in the same position and not sure if posting will delay.

Thanks!
