Hi all,

I am seeking some help and advice.
i have been separated with my ex for about 2years now, we still live together due to financial reason (she cannot afford the high rent).

My dream would be to buy a house for her my 2 kids and she can pay a part of the mortgage only (mortgage on my name), I am whiling to do a rental agreement with her and keep everything clean.
My question is, would she be able to claim Universal credit and work part time to survive. As I am the father of her kids, I don’t know if the council would accept this.

Anyone has got advice to give me?

How much child support money does CMS say you should be giving her to support your childen? The amount CMS suggest is very low and a decent dad would be giving significantly more. But depending on how that compares with the mortgage payment it might be best to give child support in the form of paying the mortgage so no rent.

Were you married? Did she sacrifice her earning potential in order to look after the kids you brought into the world together and which you are equally responsible for? How much of her current financial restrictions are due to sacrifices she made in order that you could keep your earning potential high?

It's nothing to do with the council. UC is paid by the DWP. It's unlikely she would get Uc rent element paid when you are the father of her kids. She would need to check this out with Uc but generally they will not pay rent element when you rent off a close relative. If they won't accept it as a legitimate rent then she could just not claim the rent element of Uc and get a higher work allowance instead. When you apply for UC rent element it asks if you are related to your landlord. Sounds like you basically want benefits to pay your mortgage to house your own kids !

She can. I rented from my mum (she's owns 3 properties) I declared everything, we had a formal tenancy agreement etc.
Yes, extra checks were done of course but it was actually quite a smooth process. Back then it was housing benefit so paid by the council.
I now privately rent a property my uncle owns, again, same checks but with UC.
There is nothing dodgy going on. I just happen to have relatives in a different financial situation to me.
I have a tenancy that is no different to any other private tenant. I pay the market rate (no family discount) & all is above board.

It's a bit of a grey area. I could not as it was our previous family home. However it appears you can if it's a different home. It's best to explore your options before committing to it.

As i understand as long as you are divorced and have a tenancy contract drawn up by a lettings agent all above board it is fine.

You ex will upload the contract to UC and they will ask if you are related..i think you can say no...but if you do they just have a look and ask some questions to ensure your not being dodgy or live there too.
