Question about form D11

Ellie991 · 07/01/2024 13:59

I was wondering if anyone could direct me to where I could possibly find guidance of how to fill in D11 or a completed one for the purpose of delaying a final order until finances are sorted. I unfortunately can't afford a solicitor and not entitled to legal aid. Conditional order is due to be applied for next week by STBX. He is being very difficult. Missed amicable meetings to discuss finances and is refusing to share form E.

I would appreciate any help with this please. Thank you.

I would say, fill the form as best as you can. Hand it to the court with a note that you did what you thought it was required and your intention of what you intend to do. They will return it to you if anything is wrong or more info is needed.
I did that and it was fine.

Thanks for this. A friend suggested I write this "I respectively request the honourable judge to grant a stay on proceedings until financial matters have been discussed, agreed and signed off." Can I please ask if this is roughly in line with what you've submitted and received approval for. I've searched for specific examples but couldn't find any available online. There is no other detail for me to add- we basically just need to discuss finances and come to an agreement.

Mine was to withdraw the case but i didn't know if it was the correct form as D11 says to extend, stop an order but in my case the order wasn't issued yet, it was going to trial. They send it back and told me to attach a statement the reasons why i was withdrawing. As i said i added a handwritten note saying i wasn't sure if this was the correct form as i did not have legal representation but what i wanted to do is withdraw the case.

You can't just write to the judge. Submit urgent D11

Section 3 the applicant is prevented from applying for final order because the financial matters have not yet been resolved.

  1. No
  1. No
  1. 10 mins

Thank you. I'm relieved that a short explanation should be fine. I was worried as I read somewhere I needed about a page's length and to include every detail possible.
