Clean break order/xh cc debts since separating

Hi everyone,
Divorced my Xh last year and on the whole we get along amicably and co parent well to dc (2)

Looking to get a clean break order but he told me recently how he’s ran up credit cards and has spent all his savings. He’s on a very decent salary, meanwhile I am currently on UC looking after dc and struggling to find a job which will fit around childcare hours.

I have a few thousand in savings (which has all been declared to UC). If we were to get a clean break order would I be expected to help pay off his cc debts/give him half my savings? We have agreed that as we had no assets (always rented) and separate bank accounts that he keeps his money and I would keep mine.

Do you think a judge would grant such an order if he has racked up credit cards after we separated? He has been on numerous holidays this year while I have been scrimping and budgeting. I know I’ll need to consult a solicitor but have already spent thousands on this divorce. Any advice appreciated :)

How much does he owe?

@tescocreditcard hi, few thousand I think but can’t say for sure.

My solicitor said they would be all down to him if in his name solely

My ex H had debt. I want made to pay half when we had a clean break divorce. To be fair to him, he never asked.

There have been several posts like this recently where lack of a financial part of the divorce has caused issues down the line. I'm baffled how this happens. Yes you were even stevens then but the whole point is to avoid financial entanglement down the line. Were you advised by a solicitor at the time?

Sorry not having a go as I was unaware as of a few weeks ago, it just seems strange.

I imagine his debts would be in his name however that doesn't mean that he can't get your savings if he is at 'zero' and you aren't. Has he got married since? Does he own a house that you can use as leverage so you don't pay your savings and won't got after his acquired assets etc.

Hope it goes ok.
