Divorce and Pension

H and I have essentially lived as friends for a long while now and I think once kids have gone we will go our separate ways. No drama hopefully and we should be able to remain civil.

one question I am really confused about is pensions . I have a much better pension, but intend to take it in a few years while H will work for much longer. How does that pension get shared? Am I better to wait until I’ve taken my pension or just get it done now? Does the pension sharing order change if you have retired and the other hasn’t?

In general, after a long marriage, the pensions are equalised. This applies in whatever form the pension provision is held. If you have taken your pension then it is still shared.

There are exceptions. For example if you are much older and approaching pension age it might not be equalised. This is because you would have more need. This won’t apply if you are retiring early because you don’t need to retire

To split pensions is a very specialised skill. You will jointly have to pay for a specialist report in order to do so fairly, probably by a specialist actuary.
