Mesher Order

If you have a Mesher Order for say 30% when the house is to be sold, will this still be considered capital for DWP benefits even though you couldn't access the capital until a trigger i.e youngest child not in full time education and your ex sells the house.

Mesher Orders are almost always a terrible idea and if the non-resident is relying on benefits then they are a worse idea still. I'm not sure what the universal credit impact will be during the term of the order but when the capital is finally received it will impact their income and with 30% they are unlikely to be able to buy anything. So I would strongly recommend that they don't consider a Mesher Order in the first place.
