Can I be forced to get a divorce?

My question is, if my husband files for a divorce, do I have to sign it? Can I defer it?

Why would you want to stay married to someone who doesn't want to?

Exactly.

You can delay it a bit but he'll get it dvebtually via court. I wouldn't delay the inevitable unless you're here on marriage work visa perhaps in which case talk to a lawyer

Where are you, that makes a difference.

But like pp why ?

TwilightSkies · 16/07/2023 15:15

It’s controlling not to sign it!

INeedAnotherName · 16/07/2023 15:17

Which country are you in?

In England and Wales the new no fault divorce was brought in last April. This means there's no defence needed, or separation for years. You can't delay it as the one who instigates it can ask a judge to sign on your behalf (even forcing the sale of the matrimonial home).

I'm sorry, but you can't say no.

VeridicalVagabond · 16/07/2023 15:20

For what purpose would you want to refuse? I can't imagine wanting to stay married to someone who didn't want to be married to me, and I can't think of any reasons to try and prevent divorce happening that aren't selfish or misguided.

If he wants a divorce, you’re getting divorced.

The best thing you could do now is to be proactive: get a solicitor, gather up as much financial information as you can, take photos/screenshots of bank statements/insurances/mortgages etc.

You can’t stop the divorce. You can ensure you come out of the other side in the most positive way possible.

And?

gogomoto · 16/07/2023 15:21

You can't stop it no, you are better off negotiating a decent settlement than being obstructive

cobden28 · 16/07/2023 15:22

If your husband is insisting on a divorce, make sure you get a settlement that's fair to you and not angled in his favour. Seek advice as to what you're entitled to - try the local CAB first. If this isn't their side of the house, they'll be able to pint you in the right direction.

Are there circumstances that are beneficial to you by remaining married?

Angeldelight21 · 16/07/2023 15:33

I think, I got the answer. Thank you to all for replying?

Has he sprung it on you with no warning?

Make sure you see a solicitor if you haven't already.
