me and my ex have a 3yo together and split about 6 months ago - currently still living in same house but that is to change soon.

Ex is demanding 50/50 custody of lo.

I strongly believe this is to only upset me. I offered him 2/3 overnights a week which i thought was fair.

LO is with me most of the time - my job revolves around the children and their childcare whereas ex works from 7am - 530pm and goes to his football at weekend. When i challenged him how he would manage 50% he smugly said that its based on overnight stays and that he would just have to put LO in childcare for longer or ask his mum to help.
This is unacceptable to me, why would this be ok to have him sat at childminders until early evening when i finish at 230 and could have him with me? I do everything from appointments/homework/cooking etc.
He is a good dad and i would never stop him seeing him but he is very bitter because i ended the relationship and as i said previously i think he only wants to hurt me.

I understand how upsetting that is, but if he's as you say, a good dad..I'm not sure that's a huge amount you can do to prevent this from happening.
You can of course take it through mediation and court..in which time he may well back down when he realise the reality of, not only making the Child Arrangements Order in the first place and then the reality of having your LO 50/50..not many in my experience see it through for very long.

I would mediate and go to court - it may be drawn out but I can't see a judge awarding 50/50 custody to somebody who can't actually fulfill that whilst you are available? I may be wrong if some threads on here are anything to go by.

To be honest, the reality of 50/50 probably won't be what he wants and is just trying to hurt you so you should probably let him try. His mum will soon get fed up of being used as childcare every time he has DC.

@Boymummy1401 could I ask what your outcome was in the end? Similar circumstances regarding ex's work pattern, me facilitating everything for the kids.
