Would my husband get help if he moved out?

We are both own the house.

He wouldn’t be classed as homeless if he owns a house - the rest depends on his earnings etc

If he is on tenancy or mortgage I don't think he can claim homeless status.
Is he in agreement to move out?

As we are separating. 1 he doesnt want to be away from the kids and 2 he wouldnt able to afford to rent elsewhere cos his self employed wages is very low as he earns £10k

What kind of help?
Depends how much he earns. The threshold for financial help for single people is pretty low. If he works full time, he probably won't be eligible for help with rent (some circumstances you can claim this even if you own a house, if there's a reason you can't live there).
If you mean help with housing, again it depends but I'd say it's unlikely he'd get help unless he is leaving his house for a very good reason (like you're abusive, or he is) and even then if he's working then he'd be considered to be able to rent privately.

He's not 'gainfully self employed' if he only earns 10k. So universal credit would expect him to get a full time job instead, or earn equivalent to full time on minimum wage (about double what he earns now).

So he stays in the house until you sort out financial settlement , and that needs to factor in accommodation for both

10k will be what he declares not what he earns - and if it truly is only that then he needs to seek alternative sharp

So were just claiming for child benefit and wtc

If he have to stay here, then that will be it till we are divorced and the house is sold.

Yes £10k is offical as shown on the tax credit.

His business fluctuates. He lose alot and then gain a bit. Ive told him for years to get a proper paid job but hes happy where he is 😕😕😕😕🤨

So here i am...fed up

What would be the worse for me? Im a childminder atm till 22nd as this self employed business is not working out for me

Also weve got 3 kids

he doesn’t need to be classed as homeless to get help.

He can claim UC because his income is so low - although that comes with strings where he’ll need to try to improve his self-employment earnings or get a job. And he can get housing allowance as part of that. He may only be entitled to a room in a shared house though.

When you split you will both need to move to UC anyway.
If he needs to claim help with rent and his earnings really are that low then he may get some help form UC but as others have said he will not be classed as gainfully self employed earnings so little so may be asked to look for alternative work. HIs share of the equity in the house could be disregarded for up to six months if it is up for sale, or I think it may be able to be disregarded longer if you are living there still. really though in the longer term when he starts earnings decently, he is unlikely to be eligible for any UC. When you split you also need to claim UC and tax credits will end.
