Am I divorced?

At a recent social gathering for my son, my husband, who I have been separated from for 8 years, informed me that he is engaged and planning to remarry. I asked him how that was possible as we have not been divorced! He replied that we were divorced as we had been separated for so long. Is he right as I have received no paperwork or anything.

For real? No you aren't divorced then. Mattiage isn't like a parking ticket...it doesn't just somehow expire.

In this in the UK? And it was a legal marriage? Then definitely not. I'd be half tempted to let the plonker commit bigamy and then shop him.

No, if your marriage was legal in the UK you aren’t divorced.

You need to first receive your Decree Nisi and then a little while later the Decree Absolute - which is the legal divorce. And you definitely should have received your copy of each.

Thanks for the replies - they were quick. We were married in 1986 and he walked out on me August 2014 as I had just finished my chemo so married a long time. Yes a legal marriage and here in the UK. Wonder what he is playing at - am tempted to let him go ahead and then report him.

No. You are not divorced. If he goes ahead with his second marriage as things stand then his second marriage will not be legal. It will be bigamous and that is illegal in the UK.

The divorce will have to be finalised.

I wonder if he has fallen for the urban myth that there is an automatic divorce after 7 years of separation. This is not true. There are steps you can take to divorce someone who's disappeared but he could hardly claim that given you saw him at a bloody social gathering!

Honestly, I would just leave him to it. I think when he goes to give notice of the wedding he'll have to produce evidence of the 'divorce' and I don't think the registrar will be accepting 'because I say so'.

Haven't you sorted out the finances yet either? You need to come to an agreement and get a judge to sign it off otherwise if you win the lottery next week he could claim half, or more seriously...have you bought a house since you separated as he could make a claim on it.
