Form E - Blatant Lies and Missing Info

WTF202333 · 20/03/2023 09:46

Has anyone dealt with something similar and if so, how was the matter dealt with?
STBXH has provided Form E, he has a Limited Company and pays himself a small wage of £20k per annum. There are multiple transfers in the account showing credits of £120k over the year from his bank accounts that he has not provided info on.
Solicitor is going to request the bank account statements for his Limited Company which will show his true earnings.
Will he face any repercussions for not providing this and for lying about his income?

He’s probably not lying about his salary
it’s very possible he pays himself a snsll wage
and the rest as dividends

@millymollymoomoo his accounting style is ridiculous. Claims he’s earning £800 per month but transferred £6k from his business account to personal account one month and £5k the next….

That's perfectly legitimate. But to answer your question he won't get into trouble for lying, it's just a stalling tactic and my husband did it for years.

The next step is to ask for more information. And to look at the company accounts. But be prepared for him to have stayed on the right side of the HMRC. Which means there will be an explanation for the payments.

He could be loaning himself the money rather than paying himself or it could be a dividend. The accounts will give the full picture.

What is the purpose of the form E by the way? Split of assets or maintenance?
