As mentioned in a previous topic., my wife and I have been seperated for 5.5 years and I'm finally trying to sort the divorce out.
I own 50% of the house she lives in
Her parents kindly bought it for us in 2099
I moved out in 2017
I want to transfer the other 50% ownership to her giving her 100%
The house cost £125,000 in 2009
I don't know value now yet but let's say for arguments sake that it's increased in value by £50,000
I believe that because it's more than 3 years since I moved out, I would be liable for GGT on gifiting my share back to her even though I didn't pay the property
So that would be CGT on £25000 for my 50% share minus the 12k allowance so CGT on 13k to pay?
I also read that I could possibly claim partial residence's relief for the years that I lived there from 2009 to 2017 which would be 8 out of the 14 years since the house was bought - so would that reduce the CGT owing by another 57%?
My head hurts!
